BY USING THIS WEBSITE AND ACCESSING THE SURVEY, YOU ACKNOWLEDGE THAT YOU HAVE REVIEWED AND ACCEPT THE TERMS AND CONDITIONS SET FORTH HEREIN AND ARE AUTHORIZED TO TAKE THIS SURVEY ON BEHALF OF, AND BIND TO THE TERMS AND CONDITIONS SET HEREIN, THE OWNER/REGISTRANT OF THIS ACCOUNT.
Access to and participation in the Survey (and any related activity) is not permitted where prohibited by law.
You acknowledge and confirm that the purpose of the Survey, including the proposed use of the Survey and the information generated in conjunction therewith (the “Purpose”) are as follows: (i) assess compliance and service quality issues with respect to endoscopy programs; (ii) identify trends with respect to specific endoscopy programs and across all endoscopy programs that have participated in the Survey; (iii) provide advice and establish recommendations regarding implementation of remedial measures regarding compliance and service quality issues; and (iv) publication of aggregated information or anonymized information and/or other general information arising from the Survey that is not associated to any individual.
You shall NOT disclose any personal information or personal health information, as such terms are defined in applicable privacy legislation. You acknowledge and understand that no personal information or personal health information is requested to be disclosed in conjunction with the completion of the Survey or any follow-up action with respect to the Survey. All right, title and interest in and to the survey and any information gathered through or in conjunction with the Survey and all findings, results, recommendations or feedback generated by or in conjunction with the survey are and shall remain exclusively owned by CAG and its licensors from the time of its creation. You agree and acknowledge that any information, input or other data you provide to CAG arising from or related to your use of and access to the survey shall become the exclusive property of CAG. You hereby waive, in favour of CAG, all moral, personality and similar rights in and to any information, text or materials submitted through or in conjunction with the survey.
YOU AGREE THAT NO REPRESENTATION AND WARRANTY IS MADE NOR ANY WARRANTY PROVIDED BY CAG WITH RESPECT TO THE SURVEY INCLUDING, WITHOUT LIMITATION: (I) THE AVAILABILITY OF THE WEBSITE ON WHICH THE SURVEY IS OFFERED; (II) THE RELEVANCE OF THE SURVEY QUESTIONS; (III) THE ACCURACY, COMPLETENESS, CURRENCY AND/OR RELEVANCE OF ANY SURVEY RESULTS, ANALYSIS OR COMMENTARY; (IV) THE ACCURACY, COMPLETENESS, CURRENCY AND/OR RELEVANCE OF ANY COMPILATION OR AGGREGATION OF SURVEY RESULTS; (V) WHETHER PARTICIPATION IN THE SURVEY AND/OR USE AND/OR RELIANCE OF THE SURVEY RESULTS OR RELATED INFORMATION COMPLIES WITH APPLICABLE LAWS OR WITH REGULATIONS OR OTHER REQUIREMENTS THAT MAY APPLY TO ANY ONE OR MORE HEALTH PROFESSIONS; AND (VI) NON-INFRINGEMENT (COLLECTIVELY, “SURVEY RELATED MATTERS”). CAG DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF ANY SORT TO THE FULLEST EXTENT PERMITTED BY LAW. USE OF THE SURVEY AND ANY INFORMATION PROVIDED TO YOU IN CONJUNCTION WITH YOUR PARTICIPATION IN THE SURVEY IS AT YOUR SOLE RISK.
YOU AGREE THAT CAG WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY SORT INCLUDING, WITHOUT LIMITATION, DIRECT, GENERAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR ANY OTHER LOSSES OF ANY SORT WITH RESPECT TO OR RELATING TO THE SURVEY INCLUDING, WITHOUT LIMITATION, ANY SURVEY RELATED MATTERS.
The interpretation of these terms and conditions is governed by the laws of the Province of Ontario, Canada. Any claim against CAG must be brought before the courts of the Province of Ontario that are located in Toronto, Ontario, Canada.
If you do not wish to be bound by, or have no authority to bind the owner/registrant of the account to, these terms and conditions you cannot access the Survey or this website. By accessing and completing the Survey, you and the owner/registrant of the account is deemed to have accepted the terms and conditions.
